These Terms and Conditions ("Terms") govern your use of the Moment Rides mobile application (the "Service") operated by Moment Labs ("we", "us", or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- "Rider" refers to any user who requests transportation through the Service.
- "Driver" refers to any user who provides transportation services through the Service.
- "Ride" refers to a transportation service facilitated through the platform, including Corridor Rides, P2P Rides, and Community Rides.
- "Platform" refers to the Moment Rides mobile application and associated backend services.
2. Eligibility
To use the Service, you must:
- Be at least 16 years of age.
- Have the legal capacity to enter into a binding agreement.
- Provide accurate and complete registration information.
- Maintain a valid mobile money account for payment purposes.
Drivers must additionally hold a valid Zambian driver's license, provide proof of vehicle insurance and registration, and pass our identity verification process.
3. Service Description
Moment Rides is a technology platform that connects riders with drivers in Lusaka, Zambia. We offer three ride types:
3.1 Corridor Rides
Fixed-route shared rides along popular corridors. Multiple passengers share the vehicle, and pick-up/drop-off occurs at designated stops. Pricing is fixed per route.
3.2 P2P Rides
On-demand, point-to-point rides. A driver is matched to your location and takes you directly to your destination. Pricing may vary based on demand, distance, and time.
3.3 Community Rides
Cost-sharing rides where drivers heading to a destination offer available seats to passengers going in the same direction. Riders contribute to fuel costs rather than paying a full fare.
Important: Moment Labs is a technology provider, not a transportation company. We facilitate connections between riders and drivers but do not directly provide transportation services.
4. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate, current, and complete information during registration.
- You may not create multiple accounts or use another person's account.
- You must notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
5. Payments
5.1 Ride Payments
- All ride payments are processed through mobile money integration.
- Riders are charged upon completion of a ride based on the applicable fare structure.
- For Corridor Rides, fares are fixed per route and displayed before booking.
- For P2P Rides, fare estimates are provided before booking. Final fares may vary based on actual route, distance, and time.
- For Community Rides, cost-sharing amounts are agreed upon between the driver and rider before the ride begins.
5.2 Subscription Plans
We may offer monthly subscription plans that provide discounted rates and priority ride matching. Subscriptions auto-renew unless cancelled before the renewal date. Refunds for unused subscription periods are not provided unless required by law.
5.3 Driver Payouts
Drivers receive payouts for completed rides minus the platform commission. Payouts are processed to the driver's registered mobile money account. Payout schedules and commission rates are communicated to drivers upon registration.
6. User Conduct
All users agree to:
- Treat other users with respect and courtesy.
- Not engage in any form of harassment, discrimination, or threatening behaviour.
- Not use the Service for any illegal purpose.
- Provide accurate ratings and honest feedback after rides.
- Not attempt to circumvent the platform to arrange rides or payments directly.
- Comply with all applicable Zambian laws and regulations.
6.1 Additional Rider Responsibilities
- Be at the pick-up location at the agreed time.
- Wear seatbelts during rides when available.
- Not damage the driver's vehicle.
- Pay the full fare for completed rides.
6.2 Additional Driver Responsibilities
- Maintain a valid driver's license and vehicle insurance at all times.
- Keep the vehicle in safe, roadworthy condition.
- Follow traffic laws and drive safely.
- Not drive under the influence of alcohol or drugs.
- Accept or decline ride requests promptly.
- Follow the GPS-suggested route unless the rider requests otherwise.
7. Safety
- SOS Feature: The app includes an emergency SOS button that alerts designated contacts and may notify local authorities. Use this feature only in genuine emergencies.
- Trip Sharing: Riders can share their live trip details with trusted contacts for safety.
- Driver Verification: All drivers undergo identity verification. The driver badge system reflects driver performance, safety record, and rider feedback.
- Reporting: Users can report safety concerns, inappropriate behaviour, or incidents through the app. We investigate all reports promptly.
8. Cancellations
- Riders may cancel a ride request before a driver arrives. Repeated cancellations may result in cancellation fees.
- Drivers may cancel an accepted ride under reasonable circumstances. Excessive cancellations may affect the driver's badge rating and account standing.
- If a rider is not at the pick-up point within the designated waiting period, the driver may cancel the ride, and a cancellation fee may apply.
9. Intellectual Property
The Service, including its design, logos, software, and content, is the intellectual property of Moment Labs. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written consent.
10. Limitation of Liability
To the maximum extent permitted by law:
- Moment Labs is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Service.
- We do not guarantee the availability, reliability, or timeliness of rides.
- We are not responsible for the actions, conduct, or negligence of drivers or riders.
- We are not liable for any loss, damage, or injury sustained during a ride.
- Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Moment Labs, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Dispute Resolution
- Informal resolution: We encourage users to contact us first to resolve disputes informally at [email protected].
- Mediation: If informal resolution fails, disputes may be submitted to mediation in Lusaka, Zambia.
- Jurisdiction: Any legal proceedings shall be brought exclusively in the courts of Zambia.
13. Termination
- You may delete your account at any time through the app settings.
- We may suspend or terminate your account for violations of these Terms, fraudulent activity, safety concerns, or extended inactivity.
- Upon termination, your right to use the Service ceases immediately. Provisions relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.
14. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated through the app or via email. Continued use of the Service after modifications constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Zambia, without regard to its conflict of law provisions.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
